Terms of Service
The agreement between you and Pennapost S.r.l.: your account, your signature and content, plans and refunds, and how to leave with everything you wrote.

1. Who we are
These Terms of Service (the “Terms”) govern your use of Pennapost, including the website at pennapost.com, the Pennapost web and mobile apps, @pennapost.com addresses and any related services we provide (together, the “Service”).
The Service is provided by Pennapost S.r.l., a limited liability company registered in Italy, with its registered office at Via de’ Tornabuoni 9, 50123 Firenze, Italy, VAT number (P.IVA) 07123450481 (“Pennapost”, “we”, “us” or “our”). Legal notices go to legal@pennapost.com. Everything else goes to help@pennapost.com.
2. Accepting these Terms
By creating an account, or by using the Service in any other way, you agree to these Terms and to our Privacy Policy, Cookie Policy and Acceptable Use Policy, which form part of your agreement with us. If you do not agree, please do not use the Service.
If you use Pennapost for a company, studio or other organisation, you confirm that you have authority to accept these Terms on its behalf. In that case, “you” means both you and that organisation.
3. Who can use Pennapost
You must be at least 14 years old to create an account, which is the age of digital consent in Italy. If the law where you live sets a higher age, you must meet that age instead, or have the consent of a parent or guardian.
You may not use the Service if we have previously closed your account for a breach of these Terms, or if the law prohibits you from receiving it.
4. What the Service does
Pennapost is an email service. It gives you an @pennapost.com address (or, on paid plans, an address on your own domain) and adds personal touches to what you send: your handwritten signature, a letterhead, a short sending delay we call drying ink, and a cryptographic seal on every outgoing message.
Pennapost also checks the seal on the mail you receive. Genuine senders are shown with a gold seal. Messages that fail the check or imitate another sender are marked and may be moved to your Suspicious folder. Tracking pixels are removed before a message opens.
We work hard to keep the Service available and secure, but we cannot promise it will be uninterrupted or free of errors. We may change, add or retire features over time. If we remove a feature you pay for, we will tell you in advance.
5. Your account
Give us accurate information when you sign up and keep it current, including a recovery email address. Your address is personal to you and may not be sold, rented or transferred.
Keep your password and passkeys safe, and turn on the security options we offer. You are responsible for everything done through your account unless it happens after you have told us it was compromised.
If you think someone else has access to your account, change your password and write to help@pennapost.com straight away.
6. Your signature and letterhead
When you draw your signature, we store it encrypted and add it only to messages you send. We never place it on anything you did not send, and we never share it with anyone else.
Your Pennapost signature is a personal sign-off, not a qualified electronic signature under the EU eIDAS Regulation. It does not, on its own, make a document legally binding. For contracts that need a qualified signature, use a qualified trust service.
You may only use your own signature, name and letterhead, or those you are clearly authorised to use. Imitating anyone else’s is forbidden.
7. Seals and suspicious mail
Every message you send from Pennapost is signed with a cryptographic seal for your sending domain, so receiving services can confirm it came from you. On custom domains, the seal works once you have added the DNS records we give you.
A gold seal tells you a message was signed by the domain it claims to come from. It does not tell you the sender is honest or that the content is safe. Take care with links, attachments and payment requests whatever the seal says.
Seal checks and suspicious-mail filtering are strong protections, but no filter is perfect. We are not responsible for losses caused by a message that was wrongly marked or not marked.
8. Drying ink
Drying ink holds each message for a few seconds after you press Send: 5 seconds on Pencil, and up to 30 seconds on Fountain and Press. While the ink is wet, you can smudge the message (return it to your drafts) or blot it (send it now).
Once the ink is dry, the message has left Pennapost and cannot be recalled. Please check important messages before the ink dries.
9. Your content
You own everything you write, send, receive and store with Pennapost, including your signature and letterhead (“your content”). We claim no ownership over it.
You give us a limited permission to store, copy, transmit, display and process your content only as needed to run the Service for you: to deliver and receive mail, keep it safe, filter spam, check seals, import mail you ask us to import and make backups. This permission ends when your content is deleted, except for copies we must keep by law or that remain for a short time in backups.
We never use your content for advertising or profiling, and we never sell it.
10. Acceptable use
You agree to follow our Acceptable Use Policy. In short: no spam, no scams, no malware, no harassment, no forged seals or spoofed senders, and nothing unlawful.
We may limit sending, pause messages or suspend accounts that put other people or the Service at risk. Where we can, we will tell you why and give you a chance to respond.
11. Plans and payment
Pencil is free for good: one @pennapost.com address and 10 GB of storage. Fountain costs $4 a month or $40 a year. Press costs $6 per person a month or $60 per person a year. Prices are shown in US dollars before tax. VAT or sales tax is added at checkout where the law requires it.
Paid plans renew automatically at the end of each monthly or yearly period, using the payment method on file, until you cancel. We will remind you by email before a yearly plan renews.
Payments are handled by our payment processor. Pennapost never sees or stores your full card number. If a payment fails, we will try again and let you know. If it still fails after 14 days, your account moves to Pencil and nothing is deleted.
12. Changing plans, refunds and withdrawal
You can change plans at any time in Settings → Plan. Upgrades apply straight away and you pay only the difference for the rest of the period. Downgrades take effect at the end of the current period.
If you cancel a yearly plan within 14 days of paying for it, we refund it in full. Otherwise, cancelling stops the next renewal and you keep your plan until the period ends.
If you are a consumer in the EU, you also have a legal right to withdraw from a paid plan within 14 days of purchase without giving a reason, under the Italian Consumer Code. Write to help@pennapost.com or use Settings → Plan.
13. Price changes
We may change our prices. We will give you at least 30 days’ notice by email before a new price applies to you, and it will only take effect from your next renewal. If you do not want to pay the new price, you can cancel or move to Pencil before then.
14. Our property
The Service, including its software, design, the Pennapost name, the pen logo and our letterhead styles, belongs to Pennapost S.r.l. and our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service under these Terms.
Please do not copy, modify, resell or reverse-engineer the Service, or use our name or logo in a way that suggests we endorse you, except where the law expressly allows it.
15. Suspension and closing your account
You can close your account at any time in Settings → Account. Before you do, you can export your mail, contacts and settings. After closing, your address stops receiving mail and your content is deleted within 30 days, apart from what we must keep by law.
We may suspend or close an account that seriously or repeatedly breaks these Terms, puts others at risk or is needed to comply with the law. Unless there is an urgent risk or a legal reason not to, we will give you notice and time to export your content.
Free accounts that have not been signed in to for 24 months may be closed after we have sent at least two warnings to the address and the recovery email.
16. Our responsibility to you
We provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided “as is” and “as available”, without other promises of any kind.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost business or lost opportunities. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or €100 if you use Pencil.
Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, death or personal injury, or any rights you have as a consumer that cannot be excluded by contract. We are not responsible for delays or failures caused by events beyond our reasonable control.
17. Your responsibility to us
If you use Pennapost for business and a third party brings a claim against us because of your content or your breach of these Terms, you agree to cover the reasonable costs and damages that result. This does not apply to consumers, and does not apply where the claim is caused by our own fault.
18. Changes to these Terms
We may update these Terms as the Service or the law changes. If a change is material, we will tell you by email and in the app at least 30 days before it takes effect. The date at the top always shows the latest version.
If you do not agree with a change, you can close your account before it takes effect, and we will refund any unused part of a paid period.
19. Law and disputes
These Terms are governed by Italian law. The courts of Florence have jurisdiction, but if you are a consumer you may also bring a claim in the courts where you live, and you keep every protection your local law gives you.
Before going to court, please write to legal@pennapost.com so we can try to put things right. EU consumers can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a term straight away, we have not given up the right to do so later.
